Terms of Service

Effective Date: 1 March 2026

These Terms of Service ("Terms") govern your use of the platform. By creating an account, you agree to these Terms.

1. Eligibility

You must be at least 18 years old and have the legal capacity to enter into these Terms.

2. Account Registration

• You must provide accurate and complete information
• You are responsible for maintaining the security of your credentials
• You must notify us immediately of any unauthorised access

3. Description of Service

The platform provides business tools including website management, e-commerce, bookings, invoicing, events, and other modules. Feature availability may vary by subscription plan and is subject to change with notice.

4. Subscription and Billing

• Subscriptions are billed monthly or annually, in advance
• Subscriptions renew automatically unless cancelled before the renewal date
• You may cancel at any time; cancellation takes effect at the end of the current billing period
• Price increases require at least 30 days' notice

BYOK Payment Model

All payment processing uses the tenant's own credentials (BYOK model). The platform does not collect, hold, or intermediate any funds. Transactions occur directly between you and your chosen payment provider. Payment disputes should be directed to the relevant provider.

5. Content Ownership

• Your content -- you own all content you create on the platform. We claim no ownership rights.
• Licence to us -- you grant us a limited licence to store, process, and display your content solely to provide the service. This licence ends when you delete your content or account.
• Our content -- the platform software, templates, and design elements are our intellectual property.

6. Acceptable Use

You agree not to use the platform for unlawful purposes, to gain unauthorised access, to use automated extraction tools without permission, to resell platform access, or to circumvent security measures. See our Acceptable Use Policy for full details.

7. Service Availability

We aim for high availability but do not guarantee uninterrupted access. We will provide advance notice of scheduled maintenance where possible.

8. Limitation of Liability

The platform is provided "as is" without warranties. We are not liable for indirect, incidental, or consequential damages. Our total liability shall not exceed the amount you paid in the 12 months preceding the claim.

9. Termination

• By you -- delete your account at any time; data is removed per our Privacy Policy
• By us -- we may suspend or terminate accounts that violate these Terms after reasonable notice

10. Governing Law

These Terms are governed by the laws of the Republic of Kenya.

11. Changes

Material changes will be notified at least 14 days in advance. Continued use constitutes acceptance.
